1. Agreement and service
These Terms are an agreement between you and Melissa Prieto, operating CMBT Athlete under the CMBT Culture brand. By creating an account, purchasing, or using Athlete OS, you agree to these Terms and the Privacy Policy.
Athlete OS organizes athlete-entered information and provides general performance guidance involving readiness, training, recovery, weight context, and breathwork. Features may evolve as the product improves.
2. Eligibility and accounts
You must be an adult with legal capacity to agree to these Terms. You are responsible for accurate account information, protecting your login, and activity under your account. Notify CMBT promptly if you suspect unauthorized access.
3. Subscription and billing
CMBT Athlete is offered as an automatically renewing subscription at the price and billing interval shown at checkout. Lemon Squeezy processes payment as merchant of record. Taxes may be included or added according to checkout settings and applicable law.
You may cancel future renewals through the Lemon Squeezy customer portal. Cancellation stops future billing and access continues through the paid period unless stated otherwise. Refunds are governed by the Refund Policy.
4. Performance guidance—not medical care
Athlete OS is an educational and performance-support tool. It does not diagnose, treat, cure, or prevent any disease, injury, or medical condition and does not replace a physician, registered dietitian, psychologist, or other qualified professional.
You remain responsible for training decisions and for stopping activity when you experience warning signs. Seek qualified care for symptoms, injury, pregnancy-related questions, eating-disorder concerns, rapid or unsafe weight loss, abnormal laboratory values, or emergencies. Never disregard professional advice because of Athlete OS content.
5. Acceptable use
You may use Athlete OS for your personal performance management. You may not share account access, scrape or reverse engineer the service, bypass payment or security controls, upload unlawful or harmful material, interfere with service operation, or use CMBT content to build or train a competing product.
6. Ownership
CMBT owns or licenses Athlete OS software, design, text, trademarks, frameworks, and content. These Terms provide a limited, personal, non-exclusive, non-transferable right to use the service while your access is valid. You retain ownership of information you enter and grant CMBT the limited rights needed to store, process, and display it to provide the service.
7. Availability and changes
We aim to provide reliable access but do not guarantee uninterrupted or error-free operation. We may maintain, improve, add, suspend, or retire features. “Coming soon” features are not part of the current paid commitment until released.
8. Disclaimers and responsibility
To the maximum extent permitted by law, the service is provided “as is.” CMBT does not guarantee athletic results, fight outcomes, weight-loss outcomes, or that every recommendation fits every individual. CMBT is not responsible for indirect or consequential loss. Nothing in these Terms excludes rights or liability that cannot legally be excluded.
9. Suspension and termination
CMBT may suspend or terminate access for nonpayment, misuse, security risk, or material violation of these Terms. You may stop using the service and request account deletion. Provisions concerning ownership, disclaimers, liability, and disputes survive termination where applicable.
10. Applicable law
These Terms are governed by the laws applicable to CMBT’s place of establishment, without removing mandatory consumer protections that apply where you live. The parties will first attempt to resolve disputes in good faith.
